Redes sociais de prefeituras desativadas e veto a inaugurações: veja regras a três meses da eleição
A partir deste sábado (6), quando faltam exatos três meses para o primeiro turno das eleições municipais de 2024, começa a valer uma série de proibições aos candidatos, em especial aos que ocupam cargos públicos.
Os gestores públicos que vão disputar cargos eletivos nas próximas eleições não podem mais participar de atos públicos da gestão, como a inaugurações de obras públicas, nomeações, exonerações e contratações.
A três meses do pleito, a data também marca o prazo para desincompatibilização de pré-candidatos que exerçam função de radialista ou jornalista e, ainda, de ordenadores de despesa.
Também existem vedações em relação à publicidade institucional. Por isso, muitas prefeituras e secretarias correspondentes desativaram as redes sociais e emitiram comunicados alertando para a descontinuidade da comunicação diária.
Nos sites oficiais das prefeituras, apenas devem ser disponibilizados os estritamente necessários conforme a legislação, como portais da transparência e acesso a serviços de servidores, sendo vetada a divulgação de atos dos gestores.
Lista de restrições:
- contratação de shows artísticos: fica proibida a contratação de shows artísticos pagos com recursos públicos na realização de inaugurações de obras públicas ou divulgação de prestação de serviços públicos.
- presença em inaugurações: candidatos não podem comparecer a inaugurações de obras públicas.
- veiculação de nomes, slogans e símbolos: sites, canais e outros meios de informação oficial não podem conter nomes, slogans, símbolos, expressões, imagens ou outros elementos que permitam identificar autoridades, governos ou administrações, cujos cargos estejam em disputa na campanha eleitoral.
- transferência de recursos: servidores e agentes públicos ficam proibidos de realizar transferência voluntária de recursos da União aos estados e municípios e dos estados aos municípios, sob pena de nulidade absoluta. A lei abre exceção para situações de emergência e de calamidade pública e quando há obrigação formal preexistente para a execução de obra ou serviço em andamento e com cronograma prefixado.
- publicidade institucional e pronunciamento: fica vedado o pronunciamento em cadeia de rádio e televisão fora do horário eleitoral gratuito, salvo quando, a critério da Justiça Eleitoral, tratar-se de matéria urgente. Além disso, passa a ser proibida a publicidade institucional de atos, programas, obras, serviços e campanhas dos órgãos públicos ou das respectivas entidades da administração indireta, salvo em caso de grave e urgente necessidade pública.
- nomeação ou exoneração: até a posse dos eleitos, fica vedado nomear, contratar, remover, transferir ou exonerar servidor público. A exceção fica por conta de cargos comissionados e funções de confiança. No caso de concursos públicos, é permitida a nomeação dos aprovados nos certames homologados até 6 de julho.

- De 20 de julho a 5 de agosto, partidos e federações poderão realizar convenções partidárias para deliberar sobre coligações e escolher candidatas e candidatos aos cargos de prefeito, vice-prefeito e vereador.
- Após a definição das candidaturas, as agremiações têm até 15 de agosto para registrar os nomes na Justiça Eleitoral.
- Até 20 de agosto, o TSE deve divulgar os percentuais de candidaturas femininas e de pessoas negras por partido para a destinação dos recursos do Fundo Partidário e do Fundo Especial de Financiamento de Campanha (FEFC), calculados sobre o total de candidaturas que constam de pedidos coletivos e individuais no território nacional, para a destinação de tais recursos públicos-
