Serão renegociadas dívidas não pagas até 23 de janeiro deste ano
Desenrola para MEI e micro e pequenas empresas começa nesta segunda
Os bancos começam a oferecer, a partir desta segunda-feira (13), uma alternativa para renegociação de dívidas bancárias de Microempreendedores Individuais (MEI) e micro e pequenas empresas que faturem até R$ 4,8 milhões anuais. Serão renegociadas dívidas não pagas até 23 de janeiro de 2024. Essa renegociação é importante para o pequeno empreendedor e o empreendedor individual possam obter recursos para manter as suas atividades.
A ação faz parte do Programa Desenrola Pequenos Negócios, uma iniciativa do Ministério da Fazenda, Ministério do Empreendedorismo, da Microempresa e da Empresa de Pequeno Porte com o apoio da Federação Brasileira de Bancos (Febraban). Essa parcela atendida é a mesma que precisa de ajuda para renegociar as dívidas e obter recursos para manter as atividades.

Para aderir ao programa, o microempreendedor ou pequeno empresário deve contatar a instituição financeira onde tem a dívida. A orientação é buscar os canais de atendimento oficiais disponíveis (agências, internet ou aplicativo) e, assim, ter acesso às condições especiais de renegociação dessas dívidas. As condições e prazos para renegociação serão diferenciadas e caberá a cada instituição financeira, que aderir ao programa, defini-las.
De acordo com a Febraban, somente os bancos cadastrados no programa ofertarão condições de renegociação de dívidas. Caso contrário, a sugestão é renegociar dívida mesmo assim ou, então, fazer a portabilidade da dívida para uma instituição financeira cadastrada.
A recomendação para as empresas que forem renegociar suas dívidas é que busquem mais informações dentro dos canais oficiais dos bancos cadastrados. “Não devem ser aceitas quaisquer ofertas de renegociação que ocorram fora das plataformas dos bancos. Caso desconfie de alguma proposta ou valor, entre em contato com o banco nos seus canais oficiais”, orienta a entidade.
O alerta é ainda para que não sejam aceitas propostas de envio de valores a quem quer que seja, com a finalidade de garantir melhores condições de renegociação das dívidas. “Somente após a formalização de um contrato de renegociação é que o cidadão pode ter os valores debitados de sua conta, nas datas acordadas”, diz a Febraban.
O Desenrola Pequenos Negócios foi lançado pelo governo federal no dia 22 de abril. Na mesma data, foi publicada uma portaria do Ministério da Fazenda definindo a participação dos bancos nas renegociações. Só entrarão nas renegociações as dívidas vencidas há mais de 90 dias na data de lançamento do programa. Não haverá limites para o valor da dívida nem de tempo máximo de atraso.
A versão do Desenrola para as micro e pequenas empresas é um dos quatro eixos do Programa Acredita, que pretende ampliar o acesso ao crédito e estimular a economia.
Apesar de a renegociação teoricamente ter entrado em vigor em 23 de abril, dia da publicação da medida provisória, os negócios de menor porte ainda não podiam pedir o refinanciamento porque as regras não estavam regulamentadas. A partir da publicação da portaria, as instituições financeiras puderam fazer os últimos ajustes operacionais para começarem as renegociações.
Crédito tributário
O programa Desenrola Pequenos Negócios oferece incentivos tributários para que bancos e instituições financeiras renegociem dívidas de pequenas empresas. As instituições que aderiram ao programa têm direito a um crédito presumido de impostos. Não haverá custo para o governo neste ano porque a apuração do crédito presumido poderá ser realizada entre 2025 e 2029. Por meio do crédito presumido, as instituições financeiras têm direito a abater de tributos futuros prejuízos em algum trimestre. A portaria também regulamentou o cálculo desses créditos.
Segundo o Ministério da Fazenda, o crédito tributário será calculado com base no menor valor entre o saldo contábil bruto das operações de crédito renegociadas e o saldo contábil dos créditos decorrentes de diferenças temporárias. As diferenças temporárias são despesas ou perdas contábeis que ainda não podem ser deduzidas do Imposto de Renda da Pessoa Jurídica (IRPJ) e da Contribuição Social sobre o Lucro Líquido (CSLL), mas que podem ser aproveitadas como crédito tributário no futuro, o que é permitido pela legislação tributária.
A concessão de créditos tributários alavanca o capital dos bancos para a concessão de novos empréstimos. Esse incentivo não gera nenhum gasto para 2024, e nos próximos anos o custo máximo estimado em renúncia fiscal é muito baixo, da ordem de R$ 18 milhões em 2025, apenas R$ 3 milhões em 2026, e sem nenhum custo para o governo em 2027.
