Para reduzir custos, muitos planos de saúde têm oferecido contratos com opções mais restritas de reembolso e, em alguns casos, até sem essa possibilidade, permitindo que seus usuários usem apenas a rede credenciada. Em outra frente, várias seguradoras têm apertado protocolos para evitar fraudes ou pagamentos indevidos. Algumas práticas, porém, são vistas com ressalvas por especialistas em direito ao consumidor.

- Planos de saúde: Governo define este mês índice de reajuste, que deve ficar em 7%
A Bradesco Saúde, por exemplo, exige que o profissional que presta o serviço ao beneficiário — médico, psicólogo, fisioterapeuta e outros — tenha registro no Cadastro Nacional de Estabelecimentos de Saúde (CNES), do Ministério da Saúde, para liberar o pagamento do reembolso.
Não previsto em contrato
Advogada do programa de Saúde do Instituto Brasileiro de Defesa do Consumidor (Idec), Marina Paullelli explica que o cadastro foi estabelecido pela pasta em 2015. O CNES, diz ela, é uma ferramenta de gestão de política pública, para que o governo federal entenda quantos hospitais, clínicas e profissionais atuam em cada região. E, na sua visão, não deveria ser exigido pelos planos de saúde:
- Planos coletivos: Reajuste, na média, supera 10% nos contratos empresariais
— No caso dos estabelecimentos públicos, há um incentivo (para que o profissional tenha o CNES), porque é uma condicionante para repasse de verbas do governo federal. Mas isso não acontece no caso dos privados. E não há previsão de multa ou penalidade para o não cadastro.
Ela avalia que a prática é abusiva porque viola a previsão contratual dos planos de saúde de garantir o reembolso dos procedimentos listados:

— Esse tipo de entrave burocrático não é algo que deve ser tratado direto com o consumidor, nem pode penalizá-lo de alguma forma.
Especialista em Direito à Saúde do escritório Vilhena Silva, o advogado Rafael Robba diz que reclamações sobre dificuldades em obter reembolso sobem desde o último semestre de 2023. As queixas são principalmente relativas a atendimentos feitos com regularidade, como os de fonoaudiologia, psicoterapia e fisioterapia, que geram mais volume de pedidos de reembolso.
- Rompimento: Alta em cancelamento de planos de saúde coletivos impacta até quem está em tratamento, o que é proibido pela ANS
— Desde o começo de 2023, as operadoras começaram a dificultar muito os pedidos de reembolso, pedindo até cópia de extrato bancário para comprovar que o procedimento foi pago, além de recibo e nota fiscal, o que não é previsto nos contratos. Exigir que o consumidor tenha essa informação (sobre o CNES) e confirme isso me parece abusivo. O consumidor virou fiscal da clínica ou do profissional?
A Agência Nacional de Saúde Suplementar (ANS) afirma que, a princípio, não há justificativa para a operadora exigir, para fins de reembolso, que o estabelecimento de saúde tenha cadastro no CNES. E afirma que a operadora não pode cobrar documentação que não esteja prevista em contrato, não sendo da responsabilidade do beneficiário constatar se o estabelecimento de saúde executor dos serviços está registrado no CNES.
Infração sujeita à multa
A operadora que exigir, sem a devida justificativa, documentos como o registro no CNES poderá estar sujeita à prática de infração regulatória, podendo sofrer punições da ANS, como advertência e multa a partir de R$ 30 mil, nos termos do artigo 91 da RN nº 489/2022.

Outros planos têm optado por oferecer planos sem reembolsos para reduzir custos e ter preço mais competitivo. A Porto Saúde, por exemplo, lançou este ano um plano para médias empresas com cobertura regional e sem direito a reembolso, mas, segundo a operadora, com preços cerca de 25% abaixo dos similares com rede aberta.
A Bradesco Saúde informou em nota que segue a legislação e a regulamentação do setor. “Trata-se de uma regulação do Ministério da Saúde que define que se ‘constitui como documento público e sistema de informação oficial de cadastramento de informações de todos os estabelecimentos de saúde no país, independentemente da natureza jurídica ou de integrarem o Sistema Único de Saúde (SUS)’”, afirmou.
